ILLUSTRATIONS.(a) A the husband of B, and C, an unmarried man, drink together. Drinking is a matrimonial offence. C has abetted A.

(b) A the mother of B, the husband of C, persuades B to spend money in other ways than those Which C approves.

As spending money in such ways is a matrimonial offence, A has abetted B.

12. When a man in the married state abets another man in the married state in a matrimonial offence, the abettor is liable to the same punishment as the principal. Provided that he can be so punished only by a competent court.

EXPLANATIONS.

A competent court means the wife having right of property in the offending husband.

13. Abettors who are females or male offenders not in the married state are liable to be punished only with scolding, abuse, frowns, tears and lamentations.

১১ ধারা। যে কোন ব্যক্তি-

প্রথম। অন্য ব্যক্তিকে কোন দাম্পত্য অপরাধ করিতে প্রবৃত্তি দেয় বা উৎসাহিত বা উদ্যুক্ত করে

দ্বিতীয়। বা তৎসঙ্গে সেই অপরাধে লিপ্ত হয় বা সেই অপরাধ করার সময়ে তাহার সঙ্গে থাকে, তবে বলা যায় যে, ঐ অপরাধের সহায়তা করিয়াছে।

অবিবাহিত পুরুষ বা কোন স্ত্রীলোকও দাম্পত্য অপরাধের সহায়তা করিতে পারে।

(ক) রাম, কামিনীর স্বামী। যদু অবিবাহিত পুরুষ। উভয়ে একত্রে মদ্যপান করিল। মদ্যপান একটি দাম্পত্য অপরাধ। যদু, রামের সহায়তা করিয়াছে।

(খ) হরমণি, রামের মা। রাম কামিনীর স্বামী। কামিনী যেরূপে টাকা খরচ করিতে বলে, সেরূপে খরচ না করিয়া, রাম হরমণির পরামর্শে অন্য প্রকার খরচ করিল। স্ত্রীর অনভিমত খরচ করা একটি দাম্পত্য অপরাধ। হরমণি তাহার সহায়তা করিয়াছে।

১২ ধারা। যদি কোন বিবাহিত পুরুষ কোন দাম্পত্য অপরাধে অন্য বিবাহিত পুরুষের সহায়তা করে, তবে সে আসল অপরাধীর সঙ্গে সমান দণ্ডনীয়। কিন্তু তাহার দণ্ড উপযুক্ত আদালত নহিলে হইবে না।

ঐ ব্যক্তি যে স্ত্রীর সম্পত্তি, সেই স্ত্রীকেই উপযুক্ত আদালত বলা যায়। ১৩ ধারা। স্ত্রীলোক বা অবিবাহিত পুরুষ দাম্পত্য অপরাধের সহায়তা করিলে, তিরস্কার, ভ্রূকুটী এবং অশ্রুবর্ষণ ও রোদনের দ্বারা দণ্ডনীয় মাত্র।

OF  AGAINST  THE  STATE.

14. “The State” shall in this Code mean the married state only.

15. Whoever wages war against his wife on attempts to wage such war of abets the waging of such be punished capitally, that is by separation, or by transportation to another bed-room and shall forfeit all his pocket-money.

16. Whoever induces friends or gains over children to side with him or otherwise prepares to wage war with the intention of waging war against the wife shall be punished by transportation to another bed-room and shall also be liable to be punished with scolding and with tears and lamentations.

17. Whoever shall render allegiance to any woman other than his wife shall be guilty of incontinence.

EXPLANATIONS.

(1) To show the slightest kindness to a young woman who is not the wife, is to render such young woman allegiance.

ILLUSTRATIONS.

A is the husband of B, and C is a young woman. A likes C’s baby because he is a nice child and gives him bunts to eat. A has rendered allegiance to C.

EXPLANATIONS.

(2) Wives shall be entitled to imagine offences under this section, and no husband shall be entitled to be acquitted on the ground that he has not committed the offence.

The simple accusation shall always be held to be conclusive proof of the offence.

EXPLANATIONS.

(3) The right of imaging offences under this section shall be held to belong in general to old wives, and to women with old and ugly husbands; and a young wife shall not be entitled to assume the right unless she can prove that she has a particularly cross temper, or was brought up a spoilt child or is herself supremely ugly.
